This website, www.htcchampions.com, (hereinafter referred to as the “Site”), is maintained by Create Marketing and Sales Solutions, Inc. (hereinafter “Create”) on behalf of HTC Corporation (“HTC”). This privacy statement (hereinafter, the “Statement”) describes the personal information that Create collects about you, why we collect it, and how we use it. Our policy also describes the choices you can make about how we collect and use your information.

By accessing or using this Site or providing information to us through the Site, you are accepting the practices described in this Statement.

If our information practices change in the future, we will notify you by posting the policy changes directly to this web page. We will post any such change before we use any of your information in any way other than as explicitly stated in this Statement. Please review this Statement periodically to see if it has been revised or amended.

Create respects your privacy. We don't sell, rent or loan any information about you to any third party besides HTC. We will collect information in order to refer you to the applicable HTC products sold by a wireless carrier or supplier, we will track the training materials that you access from the Site, document any test scores on quizzes or learning modules that you may access, if applicable, in order to improve your learning experience and to communicate with you about HTC products, services, surveys, contests, giveaways, sweepstakes and promotions. Create recognizes that it must maintain and use Site visitor information responsibly.

1. What type of information does Create collect?

We collect information (such as your name, e-mail address, and employer) that you provide when you register on the Site. We will confirm your email address by sending a confirmation email. Once we have verified your email address, we will send you an email informing you that your account is now active and that you may log in. We will maintain a record of your activity on the Site such as:

How often you log into the Site
The specific training modules and product materials you access
The quizzes we completed and the tracking of the results
Any content you download
The specific material viewed by you

Create may also track and analyze personal and non-personally identifiable information about our visitors to the Site. We will use this information to improve our site and to plan for technical improvements. We reserve the right to publish personal and non-personally identifiable summary information regarding our Site visitors to HTC. Non-personally identifiable summary information will consist of only general summaries of the activities of our Site visitors on the Site, however, Create may be required, in certain cases, to give HTC Corporation personally identifiable information about you (for example, in the event of you winning a contest or promotion).

2. Contests & Promotions

HTC may offer contests, giveaways, sweepstakes and promotions (collectively “Contests”) to Site visitors and if you decide to participate in such a Contest, you agree and accept that Create may be required by law to collect personal information to determine whether you may participate in such a Contest (such as your birth date, your state of residency and your physical address). This information will be given to HTC to administer the Contest. Create is not responsible for the distribution of any prizes won in any Contest offered through this Site. HTC will be responsible for distributing any Contest prizes. Potential winners will be required to comply with all Contest rules and to submit personally identifiable information, including but not limited to the information listed above in this section 2, but also may be required to execute and return an affidavit of eligibility and liability release and where legal, a publicity release to HTC. Contest winners will be responsible for all taxes (including federal, state and local taxes) and any other costs and expenses associated with acceptance and use of any prize awarded, including but not limited to any costs associated to the activation of wireless phone service and/or wireless phone service plan (as applicable). All Contest prize details are at the sole discretion of HTC.

3. Children Under the Age of 13

This Site does not target and is not intended for children under the age of 13. Consistent with the Children's Online Privacy Protection Act of 1998, we will never request personally identifiable information from anyone under the age of 13. If we become aware that a Site visitor is under the age of 13, we will remove his or her personally identifiable registration information from our files.

4. Links to Other Internet Sites and Services

We may maintain links to other websites that are not under our control. These websites have their own policies regarding privacy, which you should review before visiting them. We have no responsibility for linked websites and provide these links solely for the convenience and information of our Site visitors.

5. Adware & Spyware

Adware is software that is installed on your computer that can, for example, create pop-up advertisements or cause your browser to be redirected to other websites. We do not participate in or use third party services that use adware. We work to ensure that these third party adware services do not function on the Site. Spyware is also software that is installed on your computer that can, for example, record and transmit information regarding the websites you visit, or record or transmit your keystrokes to a third party. Spyware, like adware, is often installed without the knowledge of the person using the computer. We do not use spyware and we work to ensure that spyware does not function on the Site.

6. Cookies

A cookie is a small file that websites often store on your computer's hard drive when you visit their websites. A cookie may contain information that is used to track the pages of the sites you've visited. We use cookies in order to improve your learning experience. When you visit the Site, your cookie helps us keep track of your activities on the Site. As a registered Site visitor, your cookie allows us to recognize you when you return to the Site and provides you with access to content applicable to you. This information helps us serve you better by improving our site design, as well as to target HTC products, services, surveys, contests and promotions to you.

You can refuse cookies by turning them off in your browser. If you turn off cookies, however, we will not be able to track your Site activity nor will we be able to recognize you as a registered Site visitor to allow you access to the Site.

7. Email Preferences.

Create will not be emailing Site visitors directly. However, you may receive emails from HTC. You may opt-out of receiving future marketing emails from HTC by following the instructions given in email.

8. Access and Updates to Personal Information You Submit.

You may be able to update your personal information through the Site by updating your registration information you provided in connection with the Site. You will be required to sign in with your user name and password. Create does not maintain all personal information it collects in a form that can be accessed or updated by you. Create may keep records of changes to your personal information (including deletions).

9. Your Personal Information is Secure.

Create is committed to protecting the security of your personal information. A variety of security technologies and administrative procedures are in place to help protect your personal information from unauthorized access, use or disclosure with security measures appropriate to the sensitivity of the information. For example, your personal information is stored on computer systems located in controlled facilities. Internal access to users’ private and non-public personal information is restricted to Site administrators and others on a need-to-know basis.

10. Other Applicable Terms.

This Statement only governs the collection and use of personal information collected through the Site. This Statement does not modify or alter other agreements you may have, or enter into later, with Create. For example, our Terms of Service only govern your use of the Site.
